Special Prosecutor Robert Mueller Accuses Paul Manafort Of Committing Mortgage Fraud And Bank Fraud Special Prosecutor Robert Mueller has charged Paul Manafort with more crimes. Mueller has now added a number of allegations of bank and mortgage fraud. Manafort  has already been charged  with laundering millions of dollars in foreign money through American real estate. Mueller’s team has detailed  how Manafort misrepresented the nature of his income. Mueller's indictment also showed Manafort used the properties to obtain millions of dollars in mortgages. Mueller's previous allegations surrounded the handling of foreign money Manafort received from foreign governments. Mueller has now openly  accused  Manafort of committing mortgage fraud. Manafort allegedly made fraudulent representations to The Federal Savings Bank. The bank gave Manafort over $9 million in loans secured to the property. The Federal Savings Bank is a privately held niche bank in Chicago.

Florida 4th DCA Rules Victorious Foreclosure Victims Cannot Collect Legal Fees From The Foreclosing Party Florida foreclosure victims who beat their foreclosure are not entitled to attorney fees. The Florida 4th District Court of Appeals ruled homeowners cannot collect appellate legal fees despite being the prevailing party. Borrowers Frederick and Jonelle Sabido successfully argued Bank of New York Mellon  lacked legal standing  to foreclose. Apparently, someone forgot to sign the promissory note and mortgage. The successful Florida foreclosure victims then tried to collect legal expenses from Bank of New York Mellon. This is customary in most judicial foreclosure states when the lender plaintiff loses. It is also common in most lawsuits involving monetary damages or real property. The Florida 4th DCA agreed that Bank of New York-Mellon lacked standing to foreclose. 1st Freddie Mac Fire Sale Of 2018 Announced. $420 Million Of Non-Performing Loans Up For Auction Freddie Mac has announced the first Freddie Mac fire sale of 2018. The auction will consist of seasoned non-performing loans held in Freddie Mac's mortgage investment portfolio. Shellpoint Mortgage Servicing is the servicer of the loans. The Freddie Mac Fire Sale consists of four mortgage pools. The sale contains three standard pool offerings and one extended timeline pool offering. The later auction targets participation by smaller investors including nonprofits and minority or female-owned businesses. Freddie Mac announced bids for the standard pools are due from qualified bidders on March 13, 2018. The GSE also announced a deadline of March 27, 2018, for the EXPO pool. Freddie Mac is also requiring bidders to complete a qualification package in order to bid. The GSE also stated bids must be made on an all-or-none basis. Bidders can bid on any pool separately

ICE Lawyer Raphael Sanchez Accused Of Stealing The Identities Of Seven Immigrants Under Review By ICE ICE Lawyer Raphael Sanchez is accused of stealing the identities of multiple immigrants. Sanchez is the Chief ICE Lawyer for Seattle. The alleged scheme took place between October 2013 and October 2017. Prosecutors alleged Sanchez stole the name and Social Security number of a Chinese national identified only as R.H. He also stole used the birthdate of the Chinese national to pay bills. The charges state that on April 18, 2016, Sanchez sent himself an email through his government account containing an image of a U.S. permanent resident card and the biographical page of a Chinese passport issued to R.H. Foreclosure Tsunami Hits New York State As 2017 Foreclosures Are 200% Higher Than 2010 New York is facing a foreclosure tsunami. However, foreclosure across the United States are at an 11-year low. New York seems to buck the trend. ATTOM Data Solutions released its Year-End 2017 U.S. Foreclosure Market Report. The report shows foreclosure filings and scheduled auctions were reported on 676,535 U.S. properties in 2017. This is down 27 percent from 2016 and down to the lowest level since 2005. Those 676,535 properties with foreclosure filings in 2017 represented 0.51 percent of all U.S. housing units. The report also includes new data for December 2017. December 2017 is the 27th consecutive month with a year-over-year decrease in foreclosure activity. ATTOM reports there were 64,651 U.S. properties with foreclosure. Read more at MFI-Miami

PHH Executives Cry Like Frenchmen After Court of Appeals Declares Consumer Financial Protection Bureau Constitutional  The Court of Appeals for the District of Columbia reversed their  October 2016 decision  that declared the leadership structure of the Consumer Financial Protection Bureau unconstitutional. The original decision vacated a $100 million fine levied by the Consumer Financial Protection Bureau against  PHH Corporation . A three-judge panel heard the original case who ruled 2-1 in favor of PHH. The court’s  earlier decision  declared the leadership structure of the CFPB to be unconstitutional.
