Judge Rules Against Landlords Challenging NY Governor Cuomo’s Eviction Moratorium NY landlords are shellshocked! A federal judge upheld the NYS eviction moratorium. Judge Colleen McMahon rejected a challenge by a group of  New York  landlords who were seeking to end Governor Andrew Cuomo’s executive order. Cuomo extended the state’s moratorium on evictions until August 20th. The  order temporarily prohibits  landlords from initiating eviction proceedings against tenants during the pandemic. The order also bans late payments or fees for missed rent payments. The moratorium also allows renters who are facing financial hardships to use their security deposit as payment. However, the renter must repay their security deposit at a later date. Three Westchester-based landlords sued Cuomo in an attempt to block his executive order. They allege the state’s measure violated their contracts, due process, and property rights under the U.S. Constitution. Read more at MFI-Miami

New York City Landlords Go Into A Panic As 25% Of NYC Renters Didn’t Pay June Rent  New York City landlords are worried. The future looks bleak as nearly 25% of New York City renters have yet to make June rent payments. The Community Housing Improvement Program represents the owners of 400,000 small rent-stabilized units which equals 3 million units. The group claims nearly a fifth of those surveyed reported rent collections less than 60% of normal. CHIP is calling for a “massive federally-funded bailout” for renters. They believe this will mitigate the devastating impact of the rent shortfalls. Read more   at MFI-Miami

New York State Courts Just Made New York Evictions Easier For Lenders To Kick Homeowners Out Of Their Homes NYS courts have made New York evictions easier for lenders and landlords.  Lenders  are overjoyed they no longer need to prove deed ownership to the tenant during an eviction. New York attorney  Peter Roach  wrote a great blog on it on his website. The NYS Courts had held that a post-foreclosure eviction a copy of the deed needed to be exhibited to the occupant. However, the meaning of “exhibiting the deed” has been one of great debate. The court held in  Home Loan Services v. Moskowitz  that attaching a copy of the deed to a 10-day notice to quit served by “nail and mail” was insufficient to satisfy the requirement of the exhibition of the deed. Read more at MFI-Miami
